Personal information communications

The SADC communicates personal information:

  • To its employees if they need to have access to this information in the course of their duties;
  • To any other person or entity, when communication is prescribed or permitted by applicable legislation without the consent of the concerned person, or with the consent of the concerned person;
  • To external service providers with whom the SADC has entered into a contractual agreement under which the external service provider shall not use the personal information for any purposes other than the provision of said service and must destroy the personal information communicated no later than the end of the contractual agreement.

 

Consent

If you continue to use the SADC Website, if you provide this information to an authorized representative of the SADC, or if you communicate personal information to the SADC by completing a form provided by the SADC, you consent to the purposes and communications of the personal information mentioned below and above.

You must consent to the purposes, uses, and communications of your personal information before using the SADC Website. Please refer to section 1 below to identify under what circumstances the information will be collected.

 

In detail :

The present Policy outlines the measures and practices that the SADC of Antoine-Labelle (hereinafter referred to as “the SADC“) has implemented to govern its management of personal information and to protect personal information. The SADC collects personal information from its clients, visitors to its Website, or individuals applying for a job at the SADC (hereinafter referred to as “you,” “your,” or “yours“). The SADC gathers your information through (i) direct or indirect contact with an authorized representative of the SADC or (ii) the Website < https://www.sadcal.com >, for the purposes described in section 1 below.

In this Policy, the term “personal information” refers to any information collected by the SADC that allows, either alone or in conjunction with other information, to identify directly or indirectly any individual concerned by the personal information.

The purpose of this Policy is primarily to inform you:

  • Ways used by the SADC to collect personal information;
  • The nature of the personal information collected by the SADC and the purposes for which this personal information is used;
  • The manner in which the SADC may use personal information as well as third parties to whom the SADC may disclose such personal information, if applicable;
  • The various security measures implemented by the SADC to protect the confidentiality of personal information;
  • Rights that you have regarding the personal information collected by the SADC, including the right to access your personal information or request the correction of any inaccurate personal information, where applicable.

By providing one or more personal information to the SADC through (i) a direct or indirect contact with an authorized representative of the SADC or (ii) your use of the Website, you expressly consent to the SADC collecting, using, disclosing, and retaining this personal information in accordance with the terms and conditions outlined in this Policy.

The present Policy as well as any modified version thereof are subject to the applicable legislation in the province of Quebec in Canada.

 

1. In what circumstances does the SADC collect personal information, by what means, and for what purposes?

The SADC collects personal information in two circumstances: (i) when personal information is voluntarily submitted to an authorized representative of the SADC and (ii) when you use the Website.

i) Voluntary transmission of personal information to an authorized representative of
the SADC

What are the methods of collection?

The voluntary transmission of personal information to an authorized representative of the SADC can be done through various ways including:

  • By voluntarily answering questions from the SADC agents who can reach out to you directly by phone, in person, by mail, or electronically;
  • By providing personal information to the agents of the SADC by telephone, in person, by postal or electronic mail;
  • By providing information to the SADC agents electronically, by phone, or in person during job interviews;
  • By voluntarily filling out our job application form (hereinafter referred to as the “Form“) if you want to apply for a job at the SADC.

 

What personal information does the SADC collect through its authorized representatives?

In the above circumstances, the SADC can collect the following personal information:

  • The name, first name, preferred language, and some of your contact details (phone number, email address, etc.);
  • In the context of a job application, information related to your level of education or training (year of graduation, information related to primary, secondary, college, and university studies);
  • In the context of a job application, criminal records;
  • In the context of a job application, the desired position (the fact that the desired position is regular, part-time, or a student job);
  • In the context of a job application, your previous jobs and work experience;
  • Financial information when necessary for the completion of a transaction in which the individual concerned by the personal information wishes to engage;
  • In the context of a job application, personal information provided on your resume that we would need to collect to evaluate an application.

In all cases, before collecting any personal information about you, the authorized representative of the SADC will specify the personal information requested before collecting it.

 

What are the purposes of the personal information collected by the agents of the SADC?

The SADC collects personal information through the use of its agents for the accomplishment of various purposes:

  • Communicate with job candidates or potential clients and ensure that the communication towards them is personalized;
  • Doing advertising to clients, visitors, or potential job candidates;
  • Evaluate job applications;
  • Respond to your requests;
  • Evaluate your needs and interests;
  • Ensure compliance with a law, a court order, or a legal procedure;
  • Ensure the legal protection of the SADC in the event of a dispute;
  • Evaluate and improve protection and security measures;
  • To prevent or detect fraud or illegal acts;
  • Respond to complaints and requests for access, rectification, or withdrawal of consent.

 

ii) Collection of personal information through your use of the Website.

What are the methods of collection?

When you visit our website, personal information about you is collected in various ways, like:

  • Automatically through your connection to the Website (your computer and the Website’s server automatically exchange personal information during the connection);
  • Automatically by the installation of temporary login cookies on your computer and by the use of pixels;
  • Automatically through the use of our logging processes;
  • Through your email communications (if you provide us with personal information via email);
  • By the information you provide in our forms available on our Website.

 

What personal information does the SADC collect?

The SADC may collect the following personal information:

a. Automatically collected information:

When you visit our Website, personal information is collected automatically as follows:

  • By the information you provide in our forms available on our Website.
  • Your IP address;
  • Your browser (Explorer, Firefox, etc.);
  • The operating system (Windows, Mac OS, etc.) that you are using;
  • The date and time of your visit to the Website;
  • The pages that you are consulting;
  • The address of the referring site, if you access the Website from another site.

 

b. Information related to a job application:

If you complete our job application form available here: https://www.sadcal.com/emplois/, you will need to provide us with the information recorded on the form:

  • Your name, first name, preferred language, and some of your contact details (phone number, email address, etc.);
  • Information regarding your level of education or training (information related to primary, secondary, college, or university studies);
  • The desired position or job;
  • Criminal record;
  • Your previous jobs, your work experience, and your qualifications;
  • In the context of a job application, personal information provided on your resume that is necessary to evaluate your application;
  • If you own a car and a driver’s license.

 

c. Other information collected:

If you send us an email, make a request, or communicate directly with us via chat, you may provide us with additional personal information, the content of which will vary depending on the nature of the exchanges.

Please note that the personal information recorded in your exchanges and your communication history with the SADC will be collected.

Finally, any request for access, correction, or withdrawal of consent as outlined in section 7 of this Policy will require you to prove your identity by showing us a valid photo ID with your name. All other personal information on that ID can be hidden.

 

For what purposes does the SADC collect personal information?

The SADC collects your personal information for the following purposes:

  • Ensure that a visitor to the Website can connect to the Website;
  • Ensure that the Website can function properly;
  • Evaluate the effectiveness of the SADC‘s efforts to attract visitors, clients, or candidates;
  • Improve the performance of the Website and its effectiveness in retaining visitors;
  • Identify the legislative framework to which the personal information of Visitors is subject;
  • Communicate with job candidates or potential clients and ensure that the communication towards them is personalized;
  • Doing advertising to clients, visitors, or potential job candidates;
  • Evaluate the needs and interests of the clientele;
  • Evaluate the quality of job applications;
  • Ensure compliance with a law, a court order, or a legal procedure;
  • Ensure the legal protection of the SADC in the event of a dispute arising from your action or inaction or in the event of a dispute opposing you to the SADC;
  • Evaluate and improve protection and security measures;
  • Preventing or detecting fraud;
  • Satisfy complaints, requests for access, rectification, or withdrawal of consent.

 

Links to other sites

The Website sometimes provides links to other websites owned by other organizations. When you visit these sites, you will not be subject to this privacy policy, but to that of the external site, if it has one.

 

2. To whom is the SADC likely to communicate your personal information?

In general, the SADC uses your personal information only for internal purposes.

However, the SADC may communicate, transmit, or allow access to your personal information to the following individuals or entities:

  • To the employees of the SADC, if they need to access this information in the course of their duties;
  • To any other person or entity, when prescribed or permitted by applicable legislation;
  • To any other person or entity to whom you consent to the communication of the information;
  • To external service providers with whom the SADC has made a contract agreement, under which the external service provider cannot use personal information for any purpose other than providing that service and must destroy the personal information shared as soon as the contract agreement ends.

The SADC may disclose your personal information to individuals or entities that are part of the categories listed above and are located outside the borders of the province of Quebec.

 

The limits on communication and the use of personal information

The personal information collected is destroyed as soon as the purposes for which it was collected have been fulfilled, unless, of course, a law or regulation requires the SADC to retain it or a law or regulation imposes a specific retention period.

The SADC doesn’t sell personal information to third parties and doesn’t let third parties access personal information unless that access is needed to fulfill one of the purposes mentioned above and the access or communication without the consent of the individuals involved is allowed or required by law or regulation.

All applicable privacy settings for your use of the Website provide, by default, the highest level of privacy, without any intervention on your part.

 

4. How does the SADC protect the confidentiality of your personal information?

The SADC takes appropriate physical, technological, contractual, and administrative protective measures to safeguard your personal information and reduce the risks of unauthorized access, use, communication, and destruction.

Without limiting the generality of the foregoing, the Website is equipped with certain security mechanisms designed to protect your personal information, namely:

  • The personal information collected on the Website is encrypted at rest;
  • All transfers of personal information between the different components of the Website are encrypted;
  • The IT service providers of the SADC are contractually obligated to comply with various security requirements, which notably include periodic validation of security practices and processes, as well as continuous monitoring of the software components of the Website and their updates.

In addition to these measures, the SADC also provides for, among other things:

An internal access management policy for its employees. According to this policy, only our employees who need to access personal information in order to perform their duties may do so;

An internal policy for the protection of information to which employees of the SADC are subjected, to ensure the integrity, availability, and confidentiality of personal information;

A record of privacy incidents, which assists the SADC in inventorying incidents, whether minor or major, that compromise your personal information in order to ensure that these incidents do not recur and to identify necessary measures;

A schedule for keeping personal information, to make sure that personal info is destroyed when it’s no longer needed for the above purposes and the law doesn’t require keeping it anymore;

A privacy incident response plan that enables the SADC to respond effectively and promptly to breaches of your personal information;

A logging of access to your personal information;

Annual training for our staff members.

Despite these various measures, it remains impossible for the SADC to guarantee the security of the personal information entrusted to it. What measures have been implemented by the SADC regarding confidentiality incidents?

The SADC maintains a record of confidentiality incidents in accordance with applicable legislation. In the event of a breach of your personal information that poses a risk of serious harm, the SADC will take the necessary steps to notify you, in compliance with applicable legislation. The SADC will also implement measures to mitigate any harm that may result from the breach and to reduce the likelihood of the breach occurring again.

 

What is the retention period for your personal information?

In accordance with our secure retention and destruction procedures for personal information, we retain your personal information only for the duration necessary to fulfill the purposes outlined in Section 1 of this Policy or for the duration required to comply with our statutory obligations, according to the latest of these deadlines.

 

7. Requests related to personal information

i) Request for access

You or a person authorized by the Personal Information Protection Act in the private sector may submit a request for access to your personal information by directly contacting our Privacy Officer. according to the procedure mentioned below. The Responsible Officer for the protection of personal information of the SADC will grant this access unless:

  • The law prevents the SADC from granting access;
  • The SADC has a serious and legitimate interest in denying access to it;
  • Granting this access may seriously harm a third party.

In principle, the exercise of the right of access is free of charge. However, reasonable fees may be charged to the applicant to offset the costs of transcription, reproduction, or transmission of personal information. In such cases, the applicant will be informed of the amount of the fees in question before their request is processed.

You may also request to obtain a copy of the personal information concerning them by submitting a written request to the Personal Information Protection Officer following the procedure mentioned below.

In the event that the SADC agrees to any request for a copy of computerized personal information made, the SADC will ensure that it communicates this copy to the requester (or to any person or organization authorized by law to collect such personal information) in a structured and commonly used technological format. Unless the communication of this copy in such a technological format raises serious practical difficulties or the SADC or one of its service providers has inferred or created the personal information.

 

(ii) Request for correction

We request that you inform us of any changes that may affect the authenticity or accuracy of your personal information.

You or a person authorized by the Personal Information Protection Act in the private sector may also submit a request to rectify your personal information. Such a request will allow you to correct the personal information in our possession if:

  • The personal information is inaccurate;
  • Personal information is outdated;
  • Personal information is ambiguous;
  • Personal information is incomplete;
  • Personal information has been collected unjustifiably.

Alternatively, you may submit a written request asking our Manager to destroy outdated personal information or information that has been collected or retained unjustifiably. Any request for destruction or correction must be addressed in writing to our Information Protection Manager according to the procedure mentioned below.

 

iii) Request for cessation of broadcasting, de-indexing or re-indexing

The SADC may also, at the request of the individual concerned by the information or any person authorized by law to act in this manner, cease the dissemination of personal information, de-index or re-index, as the case may be, any hyperlink associated with the name of an individual concerned by personal information, subject to the criteria established by the applicable legislation in force at that time.

 

iv) Request for withdrawal of consent

Subject to your contractual obligations with the SADC and applicable legislation, the Personal Information Protection Act (if it applies to you) allows you to withdraw your consent to certain uses or communications of personal information. Please note that exercising this right may affect the SADC‘s services to you. In this regard, if you make this request, the SADC will identify the consequences of withdrawing consent on the services.

 

8. Application procedures

All requests for access or correction must be addressed in writing to Fanny La Rose, our Personal Information Protection Officer. A requester may contact her directly by sending an email to this email address: flarose@sadcal.com

The request must be sufficiently detailed to allow our Officer to assess and identify the personal information targeted by the request. In particular, the applicant must ensure that the Officer can reach them so that the Officer can assist in clarifying their request, facilitate the identification of the personal information targeted by the request, and, above all, communicate the acceptance or refusal of their request if applicable.

The Personal Information Protection Officer has the duty to process these requests within 30 days. If the request is not processed within the time frame, it is deemed to have been denied.

 

9. Complaint procedure

You may file a complaint regarding our methods, practices, and policies for the protection or governance of personal information by directly contacting our Personal Information Protection Officer at the following email address: flarose@sadcal.com

The Privacy Officer will respond to the complaint within 30 days of its receipt. If the complaint is accepted, a summary of the changes made to our methods, practices, and policies regarding the protection or governance of personal information will be provided to you.

 

10. Modifications to the privacy policy

The SADC may unilaterally amend this personal information protection policy. However, prior to implementing any changes, the SADC will provide a notice on the Website identifying the upcoming changes. Therefore, we invite you to revisit this policy from time to time and check if it has been modified. To facilitate this process, we have recorded the date of the last update of this Policy.
